120 Army — Terms of Service & Community Guidelines (v1.0)

Plain-English overview (not a contract): 120 Army is a Christian community built for prayer, testimony, and encouragement— “a church without walls.” We welcome all people and zero tolerance for harassment, hate, vulgarity, nudity, and exploitation. Below are the legally binding Terms of Service (the “Terms”) and Community Guidelines (the “Guidelines”). If anything, here conflicts with local law, the law controls.


1) Acceptance of Terms

By creating an account, accessing, or using the 120 Army app, websites, or services (collectively, the “Service”), you agree to these Terms and to our Community Guidelines below, as well as any policies we reference (e.g., Privacy Policy, Copyright Policy). If you do not agree, do not use the Service.

2) Who May Use the Service

  • Age. You must be 13+ to use the Service. If you are under the age of majority where you live, you must have your parent or legal guardian’s consent. We do not knowingly collect personal information from children under 13.
  • Account. Keep your password secure and your account information current. You are responsible for all activity on your account.
  • Organization use. If you create an account or use the Service on behalf of a ministry, church, or organization, you represent that you have authority to bind that entity to these Terms.

3) Our Mission & Values

120 Army’s purpose is to host a peaceful, prayer-centered space to ask for prayer, share testimonies, post videos/photos, and love one another. This is not a venue for profanity, sexual content, harassment, self-promotion spam, or divisive attacks. We moderate to keep this space healthy and safe.

4) Your Content & License to Us

  • Your Content. You retain ownership of content you post (text, images, audio, video, livestreams, and other materials).
  • License to 120 Army. To operate and improve the Service, you grant 120 Army a non-exclusive, worldwide, royalty‑free, sublicensable and transferable license to host, store, reproduce, adapt, publish, publicly perform, publicly display, translate, and distribute your content in connection with the Service, including to display it to other users and to promote 120 Army. This license ends when your content is deleted from our systems, except to the extent it has been shared and not deleted by others, included in backups/logs, or we are required by law to retain it.
  • AI-generated or edited content. If your content is AI-generated or substantially AI-edited, you must label it where the product provides a label. Do not use AI to impersonate real people, fabricate testimonies, or create misleading “miracle” claims.
  • Feedback. If you submit suggestions or feedback, we may use them without restriction or compensation.

5) Prohibited Conduct & Content (high level)

You may not use the Service to:

  1. Harass, bully, or threaten any person; doxing or targeted harassment is prohibited.
  2. Post or promote hate or dehumanizing speech toward people based on race, ethnicity, national origin, religion, caste, sex, gender identity, sexual orientation, disability, serious disease, immigration status, or any other protected characteristic.
  3. Use vulgar, profane, or obscene language; avoid slurs and crude or graphic sexual references.
  4. Share nudity or sexual content, including sexually suggestive or exploitative imagery of adults; any sexualized content involving minors is strictly prohibited and will be reported to NCMEC/authorities.
  5. Glorify or incite violence, self-harm, suicide, or eating disorders; do not post instructions for self-harm or violent acts.
  6. Promote criminal activity; buy/sell or solicit illegal goods/services.
  7. Post misinformation that risks harm (e.g., false medical claims, deceptive fundraising). Testimonies are welcome, but claims of medical cures must be clearly framed as personal experience, not medical advice.
  8. Spam or scams; deceptive growth tactics; chain letters; repetitive or irrelevant posts; undisclosed commercial solicitations.
  9. Infringe intellectual property (copyrights, trademarks) or publicity/privacy rights; upload only content you have rights to share.
  10. Collect data from users without consent; run unauthorized scraping, crawling, or automated access; attempt to bypass security.
  11. Impersonate others (including pastors, ministries, or staff) or misrepresent your affiliation.
  12. Interfere with worship or prayer spaces by trolling, flooding, or disruption.

Note: We may remove content that is legal but inconsistent with our mission/values. We aim to be viewpoint‑neutral about theology and politics while enforcing the standards above.

6) Community Guidelines (details & examples)

A. Prayer & Testimony Etiquette

  • Ask for prayer respectfully, avoid explicit medical details of others without consent.
  • When sharing testimonies, do not post private information about third parties.
  • If you offer counsel, keep it pastoral/encouraging; no medical, legal, or financial advice.

B. Language & Tone

  • Use gracious language; avoid profanity, crude innuendo, or blasphemy.
  • Disagree without attacks. Critique ideas—not people or groups.

C. Safety & Well‑Being

  • If someone expresses immediate danger, encourage contacting local emergency services. Use our reporting tools to flag content indicating acute risk.
  • Content that encourages self-harm or suicide will be removed; we may surface crisis resources.

D. Images, Video, and Music

  • No nudity or sexually suggestive imagery. Swimwear/family beach photos are generally fine when not sexualized.
  • Avoid graphic violence; do not post gore.
  • Use only music and media you have rights to use.

E. Ministries, Fundraising & Offers

  • Clearly disclose if a post seeks donations; link to verified sites. No deceptive fundraising, miracle-selling, or pay-to-pray schemes.
  • Limited promotion of events and ministries is allowed if on-topic and non-spammy.

F. AI & Synthetic Media

  • Label AI/synthetic audio, images, or video. No deepfakes of real people without clear satire/parody labeling and consent when appropriate. Synthetic depictions of minors are prohibited.

G. Moderation & Escalation

  • We use a mix of automated systems and human review. We may remove content, limit visibility, require edits, or suspend/terminate accounts. Repeat or severe violations may result in a permanent ban.
  • You may appeal moderation decisions in‑app where available.

7) Intellectual Property & Copyright (DMCA)

  • Respect IP. Only post content you have rights to share. If your content includes third-party material (music, images, video), you must have a license or rely on a valid exception.
  • Repeat infringers. We may disable accounts that repeatedly infringe.
  • DMCA Notices. We honor the U.S. Digital Millennium Copyright Act. Rights holders may submit takedown notices to our Designated Agent:

Notices must include all elements required by 17 U.S.C. §512(c)(3). We may share notices with the uploader via Lumen Database or similar transparency archives.

  • Counter‑notice. If you believe removal was in error, you may submit a counter‑notice per §512(g).

8) Privacy & Data

  • See our Privacy Policy for what we collect and how we use it (to be published alongside these Terms). We strive for minimal, purpose‑bound collection and do not sell personal prayer requests.
  • Sensitive content. Do not post others’ health details, home addresses, or financial info.

9) Health, Legal, and Financial Disclaimers

  • 120 Army does not provide medical, legal, financial, or counseling services. Content is for spiritual encouragement only and is not a substitute for professional advice. Always seek qualified professionals as needed.

10) Safety Tools & Reporting

  • In‑app tools allow reporting of content or users, muting, blocking, and appeal submission. We may also provide links to crisis lines.

11) Enforcement; Account Actions

  • We may: remove content; apply warning screens; reduce reach; disable features; suspend or terminate accounts; preserve and disclose content if required by law or to protect life/safety.
  • We are not obligated to monitor all content but may do so to enforce these Terms.

12) Third‑Party Links, Services, and Integrations

  • Third‑party sites and services are not under our control and have their own terms and privacy policies. We are not responsible for them.

13) Changes to the Service

  • We may change, suspend, or discontinue features at any time. We will provide reasonable notice of materially adverse changes where feasible.

14) Payments and Donations

  • Donations. Some features may be offered via monthly contributions (e.g., support tiers). You authorize us to charge your selected payment method until you cancel.
  • Refunds. Except where required by law, payments are non‑refundable. You may cancel at any time; access continues through the current billing period.
  • Chargebacks. Excessive chargebacks may lead to account suspension.

15) Legal Rights & Responsibilities

  • Section 230. Consistent with U.S. law, we are not the publisher of user content and may in good faith moderate objectionable material.
  • Indemnity. You agree to defend, indemnify, and hold 120 Army, its officers, directors, employees, and volunteers harmless from claims arising out of your content or breach of these Terms.
  • Disclaimers. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW.
  • Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, 120 ARMY AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA. OUR AGGREGATE LIABILITY IN ANY 12‑MONTH PERIOD WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THAT PERIOD.

16) Arbitration & Class Action Waiver (U.S. Users)

  • Binding Arbitration. Any dispute arising from or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, not in court, except for claims eligible for small claims court.
  • No Class Actions. You may bring claims only in your individual capacity; class, consolidated, or representative actions are not permitted.
  • Opt‑Out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing info@120army.com with your name, username, and a clear statement that you opt out.
  • Arbitration Rules & Venue. Administered by JAMS under its Streamlined Rules. Venue: King County, Washington, unless both parties agree to remote proceedings.

17) Governing Law & Venue

These Terms are governed by the laws of the State of Washington, excluding its conflict-of-law rules. For matters not subject to arbitration, the exclusive venue will be the state and federal courts located in King County, Washington.

18) Termination

We may suspend or terminate your account at any time for violations of these Terms or to protect users. You may also delete your account at any time. Certain provisions (e.g., licenses, disclaimers, arbitration) survive termination.

19) Changes to These Terms

We may update these Terms from time to time. We will provide notice of material changes (e.g., in‑app notice or email). Continued use after changes take effect constitutes acceptance.

Community Guidelines (Detailed)

These Guidelines explain how we apply Section 5 above.

1. Be Prayerful, Respectful, and Kind

  • Celebrate testimonies without shaming others.
  • Assume good faith; avoid sarcasm that belittles.

2. No Hate or Harassment

  • Do not attack a person or group’s inherent characteristics.
  • Slurs, dehumanizing metaphors, violent threats, or calls for exclusion are not allowed.

3. Clean Language

  • No profanity or obscene sexual references. Keep captions and comments family‑friendly.

4. No Nudity or Sexual Content

  • No explicit nudity, fetish content, or sexualized imagery. Minor safety is paramount.

5. Safety & Self‑Harm

  • Don’t encourage self-harm or suicide. Report concerning posts so we can surface help.

6. Violence & Gore

  • Don’t glorify or depict gratuitous violence, including graphic injuries.

7. Misleading or Harmful Claims

  • Health and miracle claims must be framed as personal experiences; do not discourage evidence‑based medical care. No medical miracle sales.

8. Spam, Scams, & Impersonation

  • Don’t use fake engagement or mass-posting tactics. Don’t impersonate ministries or leaders.

9. Intellectual Property

  • Post only what you own or have licensed. Respect takedown requests.

10. Teen Safety & Privacy

  • Don’t post others’ private info (addresses, medical details). Use parental consent for minors where required.

11. Reporting & Appeals

  • Use in‑app tools to report violations. We will review and, when appropriate, remove content or restrict accounts. You may appeal within the app where offered.

Transparency & Enforcement Notes

  • We may publish aggregated transparency reports on moderation actions and appeals outcomes.
  • We use a mix of automated detection and human review to reduce errors and bias, with special protections for minors and first‑time users.

Terms & Conditions – Radio Streaming Services

Effective Date: March 03, 2026

These Terms & Conditions (“Terms”) govern access to and use of the radio streaming feature (“Radio Feature”) within the 120 Army App (“App”), operated by 120 Army, a nonprofit religious organization (“120 Army,” “we,” “us,” or “our”).

By accessing or using the Radio Feature, you agree to be bound by these Terms.

1. Nature of Service

The Radio Feature provides streaming access to worship music, ministry broadcasts, biblical teaching, and related faith-based audio programming.

Streaming is provided:
    •    For personal, non-commercial listening only
    •    In furtherance of 120 Army’s nonprofit religious mission
    •    On an “as available” and “as is” basis

120 Army reserves the right to modify, suspend, or discontinue the Radio Feature at any time without prior notice.

2. No Ownership or Transfer of Rights

Access to streamed content does not grant users:
    •    Ownership rights
    •    Copyright interests
    •    Download rights (unless expressly provided)
    •    Public performance rights
    •    Commercial usage rights

All intellectual property remains the sole property of 120 Army or its licensors. No rights are transferred except the limited license expressly stated in these Terms.

3. Limited License

Subject to compliance with these Terms, 120 Army grants users a limited, revocable, non-exclusive, non-transferable license to access and listen to streamed content solely for personal, non-commercial use within the App.

This license may be terminated at any time for violation of these Terms.

4. Prohibited Conduct

Users agree not to:
    •    Record, copy, reproduce, download, distribute, or rebroadcast streamed content without authorization
    •    Circumvent digital protections or security features
    •    Use automated systems to scrape or extract content
    •    Use streamed content for commercial purposes
    •    Publicly perform content without appropriate licensing
    •    Interfere with streaming servers or infrastructure

Any unauthorized use may violate copyright, trademark, and other applicable laws.

5. Intellectual Property

All audio recordings, music, branding, logos, ministry content, graphics, and related materials associated with the Radio Feature are protected by intellectual property laws.

Unauthorized reproduction, modification, or exploitation is strictly prohibited and may result in legal action.

6. Streaming Availability Disclaimer

The Radio Feature is provided “as available” and “as is.”

120 Army does not guarantee:
    •    Continuous availability
    •    Uninterrupted streaming
    •    Error-free service
    •    Compatibility with all devices

Streaming quality may vary based on network conditions, device capability, and third-party service providers.

7. Third-Party Infrastructure

The Radio Feature may rely on third-party hosting services, content delivery networks (CDNs), or digital distribution providers.

120 Army is not responsible for service interruptions, outages, or failures caused by third-party providers.

8. Limitation of Liability

To the fullest extent permitted by law, 120 Army shall not be liable for any indirect, incidental, consequential, or special damages arising from use of the Radio Feature, including but not limited to:
    •    Service interruptions
    •    Data loss
    •    Device incompatibility
    •    Streaming errors

Use of the Radio Feature is at the user’s own discretion and risk.

9. Indemnification

Users agree to indemnify, defend, and hold harmless 120 Army, its directors, officers, volunteers, affiliates, and ministry partners from and against any claims, liabilities, damages, losses, or expenses arising from:
    •    Violation of these Terms
    •    Misuse of streamed content
    •    Infringement of intellectual property rights

10. Termination of Access

120 Army reserves the right to suspend or terminate access to the Radio Feature at its sole discretion if these Terms are violated or if misuse is suspected.

11. Governing Law

These Terms are governed by the laws of the State in which 120 Army operates, without regard to conflict-of-law principles.

Any disputes arising from use of the Radio Feature shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

120 Army may update or modify these Terms at any time. Continued use of the Radio Feature after changes are posted constitutes acceptance of the updated Terms.
